Subclass 400 Visa: Temporary Work (Short Stay Specialist) Visa

The Subclass 400 Visa is a short-term visa designed for individuals who have specialized skills, knowledge, or experience that is not readily available in Australia. This visa allows skilled professionals to work temporarily in Australia for up to 6 months to fulfil critical work requirements or complete specialized projects.

Key Benefits

  • Quick Processing: Applications are typically processed within 28 days.
  • Short-Term Engagement: Ideal for urgent, specialized work assignments.

  • Family Inclusion: You can bring family members, but they cannot work.

Who Is Eligible?

The Subclass 400 Visa is designed for professionals with specialized skills not readily available in the Australian labour market. Applicants must meet the following criteria:

  • Specialized Skillset: Demonstrate specialized skills, knowledge, or experience that is crucial for the Australian employer
  • Genuine Temporary Stay: Provide evidence that your stay is genuinely short-term and specific to the project.
  • Australian Business Sponsorship: Secure an invitation or support letter from an Australian company outlining the need for your specialized skills.
  • Sufficient Funds: Show that you can support yourself and any accompanying family members during your stay.
  • Health and Character Requirements: Meet Australian health and character standards, including possible medical examinations and police checks.
  • No Adverse Immigration History: Have a good immigration record with no prior visa breaches.

Eligibility Assessment

We begin with a comprehensive evaluation of the business’s requirements and the potential employee’s eligibility for the Subclass 400 visa. This process involves an in-depth analysis of the project's scope, the specific skills needed to accomplish it, and the intended duration of the employment. We also assess whether the employee’s qualifications and experience align with the project demands, ensuring a high likelihood of visa approval and a swift start to the assignment.

Document Preparation and Submission

Our experienced team meticulously prepares the visa application, ensuring that all required documentation—such as proof of the temporary skilled work need, employee qualifications, and evidence of the project’s short-term nature—is accurate and complete. By submitting a fully compliant and thoroughly documented application, we work to reduce potential delays and optimize the processing timeline, facilitating a smooth and efficient visa approval process.

Specialised Advice for Short-Term Projects

Recognizing the unique nature of the Subclass 400 visa, we provide tailored advice to help businesses structure their employment arrangements to meet visa requirements. This includes guidance on drafting appropriate contract terms, defining permissible activities under the visa, and ensuring that the role aligns with the specific short-term needs of the project. Our goal is to enable businesses to utilize overseas talent effectively while remaining fully compliant with immigration regulations.

Compliance Support

We ensure that both the visa application and the subsequent employment arrangement adhere to all relevant Australian immigration laws. This includes advising on maintaining proper records and documentation, such as employment contracts and evidence of compliance with visa conditions. Our support helps businesses avoid legal complications and ensures that both employer and employee meet their obligations throughout the visa’s duration.

Post-Lodgement Support

Once the application is submitted, we continue to provide support by monitoring the application's progress and managing any queries or requests for additional information from immigration authorities. Our team is available to address any issues that may arise during the employee’s stay, offering consultations for further assistance and ensuring a seamless experience for both the business and the employee throughout the visa process.

Hi, i am

Ieva Vaityte

I’m Ieva, and my journey started in a fast-paced corporate immigration law firm in Australia. It was there that I mastered the ins and outs of immigration law, but something was missing: a human connection. I often saw clients treated as just another case number, which didn’t sit right with me. Immigration is personal. It’s about people, families, and their dreams. That’s why in 2018, I founded Immi Response—to provide more than just legal advice. I wanted to offer understanding, guidance, and hope.

Our mission is simple: to treat every client as an individual, not just a file. Our values—transparency, client focus, fast response, ethical guidance, and adaptability—ensure that we meet each client’s unique needs with respect and expertise.
